Campaign General Terms “myPOS MasterCard payments”

Definitions:

“Game” means a campaign, that is managed by the Organizer, for the Game Period, in accordance with the present General Terms.

“myPOS Glass” is a software solution that allows the merchant 's smartphone to function as a POS terminal. With myPOS Glass, the merchant accepts card payments from end users directly through his smart phone without the need to use a separate device for a POS terminal.

“Participant” means a Merchant, who uses the myPOS Glass Service and conforms to all of the below:

1 The Merchant must accept a minimum number of payments with MasterCard and/or Maestro payment cards, via myPOS Glass;

2 The Merchant is not a member or shareholder or works under an employment relationship or on the basis of another contract with the Organizer or any Related Party within the meaning given in the LPOS, or is engaged in an activity related to the realization, provision and administration of the campaign. In the event of such incompatibility with this requirement, the Organizer shall cease such person's right to participate until the incompatibility of the Participant is proven non - existent;

3 The Merchant is established in a member-state of the EEA.

“Game Period” means the time frame, during which the Participants can participate in the Game in accordance with the current General Terms and Conditions.

The current General Terms and Conditions establish the rules in accordance to which the Promoting Campaign for cashless payments with Mastercard and Maestro via the myPOS Glass Service is conducted in Italy, Bulgaria and France. The Game is carried out with the support of MasterCard.

The General Terms and Conditions are prepared in accordance with the requirements of the Bulgarian legislation and are published on the myPOS website.

By participating in the Game the Participants are bound by the present General Terms and agree to comply with the latter.

1 GAME ORGANIZER

1.1 The Organizer of the campaign is myPOS AD, registered in the Commercial Register, with UIC 205050564, registered and head office: Bulgaria, Varna, Business Park Varna B1 (“Organizer”).

2 GAME PERIOD

2.1 The Game shall be in effect for three calendar months.

2.2 The Game shall start at 00:00 (UTC+2) on the 08.03.2021 until 23:59 (UTC+2), on the 07.06.2021.

3 TERMS FOR PATICIPATION

3.1 Each person/entity, which adheres to the definition of a “Participant” and is not barred for any other legal reason from participation in this Game, is able to participate in the latter.

4 GAME MECHANISM

4.1 The Game is divided in three separate cycles. Each cycle continues one month, where for each cycle 3 (three) Participants are picked for Winners through a random draw.

4.2 In order to have a chance to win a Prize through the lottery, the Participant aims to accept more than 15 card payments via myPOS Glass, each of which has a minimum value of 5 (five) EUR and is made with a Mastercard and/or Maestro payment card.

4.3 In case the requirements are met the Merchant is automatically included for a draw in the lottery. Any Merchant, that does not wish to participate in the Game can send us their preference to [email protected].

5 PRIZES AND WINNERS

5.1 The Participants of the respective cycle shall each have the chance to win 1 (one) of 3 (three) smart watches Huawei GT2, designated for said cycle.

5.2 Within a period of 2 (two) weeks after the end of each of the three cycles of the Campaign, the Organizer shall pick the names of three Participants who shall win the prize, using an automatic software RANDOM NAME PICKER (https://commentpicker.com/random-name-picker.php).

5.3 For each cycle the Organizer shall also pick three Participants as reserves, in case the primary Winner does not come forward to receive its prize.

5.4 The Participants picked as Winners shall be notified via their contact data, submitted during the registration process for the myPOS service no later than 1 (one) week after the pick.

5.5 The Winners shall receive their prizes within two weeks of the confirmation set out in pt. 6.1., via courier service on their address registered for the myPOS Service.

6 TERM FOR ACCEPTING PRIZE

6.1 The Participant shall have 1 (one) week as of the notification to him/her for the winning of the prize to confirm his/her wish to receive it and to provide an address to which he/she wants it shipped to.

6.2 In case the Organizer is unable to contact the Participant, who has been picked as a Winner, within a period of 1 (one) week as of the first attempt to contact, such Participant shall be disqualified and the prize shall be offered to one of the reserve winners, starting from the first one drawn.

6.3 The new Winner is subject to the rules in art. 6.2 - in case it’s not possible to contact him/her in a period of 1 (one) week, the prize shall be offered to the next Participant, picked as a reserve. If in the abomination term, the Organizer does not succeed in contacting any of the picked Participants, or in the event that they refuse to accept the offered Prize, the Organizer shall be released from his obligation to giveaway the prize.

7 PERSONAL DATA

7.1 The Organizer shall process the personal data in accordance with Regulation (EC) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("General Data Protection Regulation"), as well as any applicable national legislation. Detailed information on the purposes and legal basis for the processing of personal data; the categories of recipients of personal data; the period for which the personal data shall be stored; the rights of data subjects in relation to the processing of their personal data by the Organizer as well as information on how they can be exercised; contact details of the Data Protection Officer, and any other information which is required to be provided in accordance with the General Data Protection Regulation to the data subjects is contained in the Privacy Notice for myPOS Promotional Campaigns

8 PUBLICITY

8.1 The current General Terms and Conditions shall be made public and available throughout the Game Period on the Organizer's website at myPOS.com.

9 LOSS OF RIGHT TO PARTICIPATE IN THE GAME

9.1 Any Participant who fails to meet any of the requirements, expressed in the definition of “Participant”, shall lose the right to participate in this Game.

10 TERMINATION OF THE GAME

10.1 The Organizer has the irrevocable right to terminate the Game at any time, by declaring this in accordance with Section 8 Publicity, in the event of circumstances beyond his control which hinder the Game’s further performance and cannot be eliminated by the Organizer.

10.2 The Organizer has the irrevocable right to terminate the Game at any time without notice to the Participants if he finds abuse or gross violation of the rules, in case of force majeure or for other objective reasons, including but not limited to material losses, an order of the competent state authorities for the suspension of the Game, and others. In the event of misuse, negligence, or violation of the General Terms by a Participant, the Organizer has the right to disqualify him.

11 FINAL PROVISIONS

11.1 The Organizer reserves the right, at his sole discretion, to amend and supplement the terms and conditions of this Game, and any changes shall be made public and available to all participants and users in accordance with Section 8 Publicity.

11.2 Any change in the terms of the Game Period shall be duly published on the official website myPOS.com.

11.3 For the cases not settled by the current General Terms and Conditions the provisions of Bulgarian law shall apply. Any dispute, contradiction or claim arising out of or relating to the performance, interpretation, application or termination of the General Terms and Conditions shall be governed by the parties through mutual concessions. If the parties fail to settle their relations out of court, the relevant Bulgarian court is competent to resolve the dispute, in accordance with the Bulgarian legislation.
